These Terms of Use (the “Terms”) govern your use of Heart Rate & Health - Novaz (the “App”) and our website (together, the “Services”). Our Privacy Policy also applies. By using the Services, you agree to these Terms; if you do not agree, do not use the Services. We may revise these Terms, and continued use after a change means you accept the revised Terms.

Not a medical device

Heart Rate & Health - Novaz is a wellness app, not a medical device. It is not certified to diagnose, treat, prevent or monitor any condition, and nothing it shows should be used to make a medical decision. Its readings are estimates from your phone’s camera and are not a substitute for a clinical measurement or for advice from a doctor or other qualified professional.

The camera can read a pulse. It cannot measure blood pressure or blood oxygen; those values are entered by you from your own devices, and the App shows them as you entered them. Suggestions in the App are general lifestyle guidance, not personal medical advice.

If a reading worries you, or you have chest pain, shortness of breath, fainting or an irregular heartbeat, contact a healthcare professional or emergency services — do not rely on the App.

Accuracy

Camera-based readings depend on your finger position, movement, lighting and device, and can be wrong. The App withholds a result when a recording is too noisy, but we do not guarantee the accuracy of any reading, score or estimate. Reference ranges follow published guidance from the American Heart Association, the American Diabetes Association and the National Heart, Lung, and Blood Institute.

Your responsibilities

  • You may use the Services only if you are 13 years or older.
  • You are responsible for how you use your readings and for any decisions you make about your health.

Purchases and subscriptions

Heart Rate & Health - Novaz PRO is an auto-renewing subscription, offered weekly (with a free trial) or yearly. Payment is charged to your Apple Account at confirmation of purchase and is processed by Apple; trials, renewals, cancellations and refunds are subject to Apple’s terms. A subscription renews automatically unless cancelled at least 24 hours before the end of the current period. If you start a free trial, you will be charged when it ends unless you cancel before then, and any unused part of a trial is forfeited when you buy a subscription. Manage or cancel at any time in Settings › Apple Account › Subscriptions.

Intellectual property

Novaz and its licensors own the Services. We grant you a limited, non-exclusive, non-transferable license to use them for your own personal purposes in accordance with these Terms. Apple Health, iPhone, iPad and App Store are trademarks of Apple Inc. Heart Rate & Health - Novaz is not affiliated with or endorsed by Apple.

Acceptable use

You agree not to — or attempt to —:

  • use the Services as a substitute for professional medical care;
  • decipher, decompile, disassemble or reverse engineer the software, except to the extent permitted by law;
  • interfere with or disrupt the Services;
  • violate any applicable law, or encourage anyone else to.

Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, AND WE DO NOT WARRANT THAT ANY READING, SCORE OR SUGGESTION IS ACCURATE, COMPLETE OR SUITABLE FOR YOUR NEEDS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOVAZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR ANY HARM ARISING FROM RELIANCE ON ANY READING OR SUGGESTION. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Governing law and general

These Terms are governed by the laws applicable to Novaz, without regard to conflict-of-laws principles. If any provision is unenforceable, the rest remains in effect.
